Terms of Service
1. Agreement
These Terms of Service ("Terms") form a legal agreement between you and Ihtaraf ("we", "us", "the platform"). By creating an account or using ihtaraf.com, you agree to these Terms.
If you don't agree, don't use the platform. If you have questions, email privacy@ihtaraf.com before signing up.
2. Who can use Ihtaraf
You must be 18 years or older to create an account or sign up for matches. By using the platform, you confirm that:
- You are at least 18 years old
- You have the legal capacity to enter into this agreement
- You are not barred from the platform under any prior suspension
- You are using the platform for personal, non-commercial purposes (commercial organizers must contact us first)
3. Your account
You are responsible for:
- Keeping your sign-in credentials secure
- All activity that happens under your account
- Providing accurate display name, contact info, and profile details
- Notifying us promptly if you suspect unauthorized access (email privacy@ihtaraf.com)
You may not:
- Create more than one account per person without our written permission
- Impersonate another person, including using their name, photo, or contact details
- Sell, transfer, or share your account with anyone else
- Use automated tools (bots, scrapers) to interact with the platform
4. How to behave on the platform
Ihtaraf is a community space. Behave the way you'd want others to behave with you. Specifically, you agree not to:
- Harass, abuse, or threaten other players or organizers
- Post discriminatory, hateful, or inappropriate content in any free-text field
- Manipulate skill ratings or MVP votes through coordinated voting, fake accounts, or bribery
- Spam other players, organizers, or the platform itself
- Reverse-engineer, copy, or attempt to extract data from the platform
- Use the platform to facilitate gambling or prohibited financial activity
Violations may result in account suspension or termination at our discretion.
5. Match participation
Matches on Ihtaraf are organized by community members ("organizers"), not by Ihtaraf itself. We provide the platform; organizers run their own matches. By signing up for a match, you agree to:
- Show up at the time and location stated, ready to play
- Cancel your signup at least 6 hours before kickoff if you can't make it
- Follow the organizer's house rules, format, and on-pitch instructions
- Treat other players, the venue, and the equipment with respect
- Accept that match cancellations, time changes, or venue changes can happen — organizers will notify you in the app
Ihtaraf is not responsible for: organizer behavior, match outcomes, venue conditions, equipment, refereeing decisions, or injuries sustained during play. Football is a physical sport; you participate at your own risk.
6. No-shows and skill ratings
Organizers can mark you as a no-show if you signed up for a match and didn't appear, or if you cancelled too late. Repeated no-shows may result in:
- Lower priority on future signups
- Temporary suspension from the platform
- Removal from specific organizers' matches
Skill ratings are calculated automatically from match results, MVP votes, and your placement matches. Ratings are not promises about your ability — they're statistical signals to help organizers form balanced teams.
7. Disputes
If you disagree with a no-show mark, score, or skill rating:
- Contact the organizer first — they have admin authority over matches they run. Most issues resolve here.
- If the organizer is unresponsive or you believe they acted unfairly, email privacy@ihtaraf.com. We'll review the case.
- Our decision on platform-level disputes is final, except in cases that fall under Kuwaiti law (see Section 12).
8. Payments, wallet, and refunds
Phase 1 of Ihtaraf is free for players. When paid matches are introduced (Phase 2, dependent on payment processor onboarding), the following applies:
Match fees
- Some matches will require a fee, set by the organizer
- Payment is collected at signup through Tap or MyFatoorah
- Payment confirms your roster spot
Refunds — when you cancel
- More than 6 hours before kickoff: full refund as wallet credit
- Less than 6 hours before kickoff: no refund — your spot may go to a waitlisted player, but the fee is forfeited
Refunds — when the organizer or platform cancels
- Match cancelled by organizer or venue: full refund as wallet credit, automatically
- Genuine platform error or dispute resolved in your favor: contact privacy@ihtaraf.com. We'll refund either to wallet or back to your card, at our discretion.
Wallet
- Refund credits go to a wallet attached to your Ihtaraf account
- Wallet credits never expire
- Wallet credits can be used to pay for any future match
- Wallet credits cannot be transferred to another user
- Wallet credits are not redeemable for cash, except when refunded to the original payment method during account deletion or by our explicit decision in dispute resolution
Refund timing
- Wallet credit: applied instantly
- Refund to original payment method: up to 14 business days, depending on the payment processor and your bank
9. Content and intellectual property
You keep ownership of any content you post — display name, profile photo, match notes you write. By posting it, you grant Ihtaraf a non-exclusive, worldwide, royalty-free license to display it on the platform for the purpose of running the service.
Ihtaraf's name, logo, design, code, and all platform-generated content (skill ratings, leaderboard rankings, match summaries) are our intellectual property. You may not copy or redistribute them without our written permission.
10. Limitation of liability
The platform is provided "as is", without warranties of any kind. We don't guarantee that matches will run on schedule, that the platform will be available 24/7, or that skill ratings will be perfectly accurate.
To the fullest extent allowed by Kuwaiti law, Ihtaraf is not liable for:
- Indirect, incidental, or consequential damages
- Lost profits, opportunities, or community standing
- Injuries sustained during matches
- Conduct of organizers, venues, or other players
- Service interruptions caused by our infrastructure providers (Cloudflare, Supabase, payment processors)
Our total liability for any claim related to the platform will not exceed the total fees you've paid to us in the 12 months before the claim.
11. Suspension and termination
We may suspend or terminate your account if you:
- Violate these Terms or the Privacy Policy
- Repeatedly no-show without valid reason
- Engage in conduct that harms other players or the community
- Use the platform for prohibited purposes (spam, fraud, harassment, etc.)
You can terminate your account at any time by emailing privacy@ihtaraf.com. See the Privacy Policy for what happens to your data on deletion.
On termination — whether by you or by us — any active match signups are cancelled, and any wallet balance is refunded to your original payment method where possible.
12. Governing law
These Terms are governed by the laws of the State of Kuwait. Any dispute that can't be resolved through the steps in Section 7 will be subject to the exclusive jurisdiction of the courts of Kuwait.
13. Changes to these Terms
We may update these Terms as the platform evolves. When we make material changes:
- The "Last updated" date at the top is updated
- We notify all active users by email at least 14 days in advance
- A notice is shown in the app at next sign-in
Continuing to use the platform after the change takes effect means you accept the updated Terms. If you don't agree, you can delete your account before the effective date.
